DUI Charges in Michigan
There are several different categories of DUI charges in Michigan, and the circumstances of your case will dictate how a prosecutor handles your situation. Things like your blood alcohol content (BAC), your age, the presence of any past DUI convictions, and the specific substances involved will all be considered.
Types of DUI charges in Michigan include:
- Operating while intoxicated (OWI)
- Operating while visibly impaired (OWVI)
- Operating with any presence of a Schedule 1 drug or cocaine (OWPD)
- Zero Tolerance (when you are under the age of 21)
Your first offense is usually charged as a misdemeanor. If you have a second offense within seven years of your first offense, you will again be charged with a misdemeanor. A third offense will be charged as a felony.
The penalties of a DUI conviction can include:
- Severe fines
- Jail time
- Probation
- Mandatory community service
- License restriction or revocation
- Points added to your license
- Vehicle immobilization
- Vehicle registration denial
